Consumer protection insights
Straight answers to the most common early-cancellation questions under South African law.
Can a company charge a 100% cancellation penalty?
No. Under Section 14(3) and Regulation 5 of the CPA, a cancellation penalty must be reasonable. It may take into account things like unrecovered discounts or subsidised hardware, but it may not be so high that it cancels out your right to cancel. Charging the full value of the remaining contract is not allowed.
What exactly counts as “20 business days”?
Business days exclude Saturdays, Sundays and South African public holidays (such as Freedom Day, Youth Day or Heritage Day). Day 1 is the first business day after the supplier receives your notice. Our generator calculates the end date for you. Keep proof of when the notice was delivered.
How should I deliver this cancellation notice?
Keep a clear paper trail. 1) Email it to the supplier’s official cancellations address and keep the sent email or delivery receipt. 2) Electronic messages such as WhatsApp can count as writing under the Electronic Communications and Transactions Act — screenshot the delivered ticks. 3) Ask your bank to stop the debit order once the 20 business days have passed.
