⚡ Statutory 20-business-day right

Fixed-term contract cancellation notice

gavel

Statutory ground

Consumer Protection Act 68 of 2008, Section 14(2)(b)(i)(bb)

Waivers of this right are void (CPA s51)

When to use this notice

Use it to cancel a fixed-term gym contract (e.g. Planet Fitness, Virgin Active), a cellphone or data contract (Vodacom, MTN, Telkom), home fibre, armed response or similar service before the term ends. It gives the supplier the required 20 business days’ written notice and puts them on notice that a 100% remaining-term penalty is not allowed.

What happens after you send

Follow these four steps so the company can’t keep debiting you or list you unfairly.

01

Email & archive proof

Send the notice to the supplier’s customer care and cancellations email. Save a screenshot or delivery report — this is your timestamp.

02

Instruct your bank

In your banking app (Capitec, FNB, Standard Bank, Nedbank, Absa), stop future debit orders that fall after the 20 business days.

03

Check the final invoice

They must credit any unused upfront fees. If they charge a penalty, ask for their Regulation 5 calculation. A 100% penalty is not allowed.

04

Escalate to the ombud

If they refuse to cancel or threaten collection, lodge a free complaint with the CGSO, or with ICASA for telecoms.

Know the 3 dirty supplier tactics

CPA Sections 14 & 51
1

“You signed away Section 14”

Not allowed: under Section 51 of the CPA, a contract term that waives or limits your consumer rights, including the right to cancel on 20 business days’ notice, is void.

2

“You must pay out the full 24 months”

Not allowed: Regulation 5 requires a reasonable cancellation penalty that reflects the supplier’s actual position, not the full value of the remaining months.

3

“It automatically renewed for another year”

Check this: the supplier must remind you 40 to 80 business days before a fixed term ends. If you do nothing, the agreement continues month-to-month, not for a new fixed year, and you can cancel it.
