Locked into a fixed-term MTN cellphone contract? The Consumer Protection Act lets you cancel early by giving 20 business days’ written notice, and any penalty must be reasonable. If your contract included a handset, you can be asked to settle the outstanding device balance, but not punitive extra charges.
You can cancel a fixed-term MTN cellphone contract at any time with 20 business days’ written notice. The penalty must be reasonable, not the rest of your contract.

Step by step
Generate the Section 14 letter, add your MTN account number, and email it to their cancellations address. Keep the delivery receipt.
Once the 20 business days have passed, ask your bank to stop future MTN debit orders so nothing is deducted after cancellation.
If MTN asks for the full remaining contract, ask for their Regulation 5 calculation in writing, then escalate free of charge to the ICASA consumer complaints.
“…the consumer may cancel that agreement (aa) upon the expiry of its fixed term, without penalty or charge…; or (bb) at any other time, by giving the supplier 20 business days’ notice in writing or other recorded manner and form.”

Common questions
Can MTN make me pay out my whole contract?
No. Under Section 14(3) and Regulation 5 of the CPA, a cancellation penalty must be reasonable. It may reflect things like unrecovered discounts or subsidised equipment, but charging the full value of the remaining months is not allowed.
How long does it take to cancel with MTN?
Your agreement ends 20 business days after MTN receives your written notice. Weekends and South African public holidays don’t count. Our generator calculates the exact end date.
I signed MTN’s terms. Can I still cancel?
Yes. Cellphone contracts with individuals are covered by Section 14. Section 51 of the CPA makes contract terms that take away your consumer rights void.
